Terms of Service
These Terms of Service (“Terms”) govern the relationship between the Artist (“me”) and the Client (“you”) regarding the creation of commissioned artwork (the “Commission”), outlining the responsibilities of both parties and the permitted future use of the finished artwork.If you are interested in commissioning me, please read through the Terms of Service!
If you have any questions, please see the FAQ or contact me directly.I work under the assumption that commissioners have fully read and comprehend the Terms of Service.Applying for a Commission
Commissions are opened publicly. Current state (open/closed) is published on my website, as well as on VGEN.
I have a waitlist that will have no more than 5 slots. The commissions will be closed if all of these slots are taken and they usually open once a slot opens up. I reserve the right to close commissions regardless of the current state of the waitlist.You must be 18 or over to commission me! I do not, under any circumstances, work with minors. If you apply/get a commission and I find out you are a minor, your commission will be canceled and I will not work with you in the future.Will Not Draw
As the artist I reserve the right to refuse any commission involving content or subject matter I am uncomfortable drawing. For examples of my artwork please visit one of my social media pages or my portfolio on my website.General subjects I will NOT draw on commission:
* Humans or characters with human features
* Complex architecture & vehicles
* Promotion of political views
* Anything hateful/racist/sexistGeneral subjects that I might SOMETIMES draw:

* Weight Gain

* Foot/Paw
* Chastity
* HypnosisWill Draw* All real life animals
* All mythological and made-up creatures (gryphons, dragons, custom species)
* Feral furries
* Blood & Violence (gore)If you have any questions about these restrictions, or would like clarity on any particular subject I will/will not draw, please contact me.Correspondence
All commission correspondence is done through email, vgen and bluesky. You can contact me at any time at [email protected]If for some reason I cannot contact you through the service you used ti comission me, I will attempt to reach out to one of your listed alternate contacts that I asked for when you applied for a commission. If I am able to, I will reach out through an account involving the “Cuparemy” name so you know it’s me. I will not reach out on a platform that I do not have an account on currently (Twitter/X, Tumblr, etc).My general work hours are during any day when I have free time, so I will respond to comissions and messages at my own time.If you feel like you should have received contact from me and did not, please reach out and ask! Sometimes emails land in spam folders, especially if I’m contacting several people at the same time and messages on other sites might get lost between notifications. I send out emails and messages manually so there is always a chance for human error.Payment
All commission payments are taken via invoice. You need a working email address to receive the invoice and a valid debit or credit card to pay it or a balance on paypal.All commission payments are taken in full and upfront. You will receive the invoice once I make a rough sketch that is approved by thecomissioner. Payment is not required before a sketch is approved.Your spot in the queue will only be held once you pay the invoice. Generally I give 24 hours to pay unless otherwise specified. If you need to work out a later date, please reach out to me for options. I cannot guarantee to be able to work with your payment schedule and if I cannot get the payment by the time work on your commission is scheduled to begin, your commission will be canceled and you will be removed from the queue.I do not split payments or do payment plans.I require the person who filled out the form to pay the invoice. This means no gift commissions where the person who applied passes off contact/payment to someone else after being selected. If you would like to gift a commission please be prepared to work with me throughout the whole commission process and gift the finished commission to the person yourself.I do not begin work until the payment is received and fully processed.All invoices and prices displayed are in EUR.Included on your invoice will be:
* My contact email
* The type of commission you have ordered
* A breakdown of the total price
* The option to leave a tipIf you would like to leave a tip, you can do so when you pay the invoice or after the comission. Tips are appreciated but not required!If you have any questions about payments please contact me.Commission Queue
If you have been chosen for a commission and have paid for it, you can find your current commissions status on my public Trello board queue LINK HERE. Your individual commission will have its own card.Information included on the Trello card:
* Your name/icon
* The type of commission you’re getting
* Progress Checklist so you can track its progress
* Whether or not payment was receivedYou will be given this information to confirm once your commission payment is processed.Commissions have a set date max. of one month, but typical turnaround time is about one week. You can track your progress on the Trello card or contact me for updates, any questions or concerns. I usually contact you myself if I have time or if I'm unsure about something. If one month has passed or progress has seemingly halted you are welcome to reach out to me and ask for an update. Most likely it would mean I am unable to complete your comission and will give you a refund.
After I complete a comission, I will send the finished product via email.The work queue is public and kept updated to the best of my ability. You are welcome to check your commission status at any time.Work in Progress Updates
For higher priced, custom commission work you will receive atleast one work in progress (WIP) update before the final piece is completed. This will be sent to you via the platform you chose to comission me from.After you receive your WIP, you may request edits. Minor edits are done for free and involve things such as limb placement, expression tweaks, clothing changes, etc. If I specifically miss drawing anything from the information you provided when you applied for the commission I will fix it free of charge.Major edit requests will come with an extra fee depending on the amount of work. These typically start at $5 and go up from there. Major edits include things such as redrawing an entire character or large portion of the image or multiple rounds of smaller edits. The fee will be requested via invoice and must be paid before the edits are completed. If payment is delayed too long, your commission either refunded or proceed without the edit.If your commission is edited, I will send another WIP so you can confirm all the details are correct.I will not try to replicate another artist's artstyle. Please be aware that over time, my own style changes and I will not go back and replicate artwork that I made at an earlier time in my career.You may request edits at any point in the commission process after the sketch but they will come with a larger fee at this point, depending on how much work is involved. Commissions in the ink, color, shading or finalizing stage take considerably more work to edit than commissions still in the sketch stage. Please keep this in mind when you request late stage edits.If I send you your WIP and I do not hear back from you within a reasonable amount of time, I will continue without confirmation. Typically I can give about 1 week to hear back from you before I must continue to stay on schedule. I will reach out via email a few times as well as try your alternate contact info before proceeding without confirmation.Artist Rights
As the artist, I retain full copyright to all artwork I create, automatically. You retain rights to your personal character.As the artist, I may:
* Post the artwork to any of my galleries of social media sites
* Use the artwork for advertising or personal promotion
* Reproduce the artwork for personal merchandise
* Publish or sell prints of itAs the artist, I will not:
* Sell the rights to your commission to a company

* Allow other people to edit your commission
* Trace or recolor your custom (non YCH multi-slot), completed commission for someone else
* Give out working files for your commission
* Take credit for characters I did not design
* Keep your commission private (you may remain unnamed/anonymous if you would like)You can buy rights to my artwork to use it commercialy for a fee. If this is something you are interested in you can contact me to discuss it but this must be done before you apply for a commission. I will not discuss selling rights after a commission is completed. There's a clickable option on vgen but we'll discuss it beforehand preferrably.Commissioner Rights
When your commission is completed, you will receive high-quality unwatermarked and watermarked files.As the commissioner, you may:

* Use the files for personal use (such as a desktop wallpaper or personal print)

* Take credit for creating the artwork
* Remove any of my signatures/watermarks
* Heavily edit your commission without permission
* Pay another artist to edit or alter the commission without permission
* Mass produce the artwork and sell it or profit from it unless commercial fee was properly paid.
* Use the artwork as a reward for a subscription service
* Use commissioned work for any AI/algorithm training
* Use the commissioned work for any NFT creationIf you have any questions about what you can or cannot do with your commission, please reach out and ask.If I find you breaking any of the above rules, I will not work with you again in the future.Edits on Completed Work
If you wish to have your completed commission edited, please reach out via email. You do not have to wait for an official commission opening to request an edit.These edits will always come with a fee that is based on the amount of work the edit requires. This fee must be paid before any work is started.Typically if you request an edit, I will work you into my current schedule. If the edit is on the larger side, it may take longer and we will discuss a timeframe at the time of request.I do work directly off provided reference sheets when it comes to colors. But please keep in mind I use various lighting, shading and filter effects or render style in my artwork that may make the colors or the markings in the final piece look altered. This is intentional and part of the way I work! I generally will not edit/alter the colors or patterns unless I specifically got it incorrect.I may refuse an edit if the request is content I do not feel comfortable drawing.I only offer edits on artwork that is less than one year old. If your artwork is outside this window, I will not edit if but you may commission a new, updated version during a future commission opening.Refunds
If I have begun the commission process and you decide you want to cancel it please let me know as soon as possible. I am aware that sometimes issues arise and I’m happy to work with you if such an event occurs.If I have not begun work on your commission, you will receive a full refund. If I have begun the commission process, you will receive a partial refund based on the amount of work completed.If you cancel your commission, I may reuse your commission sketch for another commission or an YCH auction (depending on the type of commission).If you cancel your commission and want another commission later, you will have to wait for a commission opening and go through the application process again.I do not pause commissions or hold spots. Your commission is either paid for and actively being worked on, or it is canceled and refunded. I will not save or hold a sketch/in progress commission for you to resume at a later date.All refunds will be issued within 24 hours after I confirm the request.Other Questions or Concerns
